All persons who sold a home that was listed on a multiple listing service (“MLS”) anywhere in the United States where a commission was paid to any brokerage in connection with the sale of the home in the following date ranges:
(a) Moehrl MLSs: March 6, 2015 to February 26, 2025;
a. Bright MLS (Delaware, Baltimore, Maryland area, District of Columbia, parts of New Jersey, Philadelphia, Pennsylvania area, Richmond, Virginia areas, parts of West Virginia);
b. Carolina/Canopy MLS (Charlotte, North Carolina area, including portions of South Carolina);
c. Triangle MLS (Research Triangle Area, North Carolina);
d. Stellar MLS Tampa, Orlando, and Sarasota, Florida areas);
e. Miami MLS (Miami, Florida area);
f. Florida Gulf Coast (Fort Myers, Florida area);
g. Metro MLS (parts of Wisconsin, including the Milwaukee areas);
h. Yes MLS/MLS Now (Cleveland, Ohio, Eastern Ohio, and parts of West Virginia);
i. Columbus Realtors MLS (Columbus, Ohio areas);
j. Northstar MLS (Minnesota, Wisconsin);
k. Wasatch Front/Utah Real Estate (Salt Lake City, Utah area);
l. REcolorado/Metrolist (Denver, Colorado area);
m. Pikes Peak MLS (Colorado Springs, Colorado area);
n. GLVAR MLS (Las Vegas, Nevada area);
o. SABOR (San Antonio, Texas area);
p. ACTRIS/ABOR (Austin, Texas area);
q. HAR MLS (Houston, Texas area);
r. NTREIS (Dallas, Texas area);
s. ARMLS (Phoenix, Arizona area);
t. and Realcomp II (Detroit, Michigan area)
(b) Burnett MLSs: April 29, 2014 to February 26, 2025;
a. Heartland MLS (encompassing the Kansas City metropolitan area, counties in eastern Kansas, counties in southwest Missouri, and counties in northwest Missouri)
b. Maris MLS (encompassing the St. Louis metropolitan area, counties in eastern Missouri, and counties in western Illinois)
c. Columbia Board of Realtors MLS (encompassing Columbia, Missouri and its surrounding areas);
d. or Southern Missouri Regional MLS (encompassing Springfield and Joplin, Missouri and their surrounding areas).
(c) MLS PIN: December 17, 2016 to February 26, 2025;
a. MLS PIN (Massachusetts)
(d) Homes in Arkansas, Kentucky, and Missouri, but not on the Moehrl MLSs, the Burnett MLSs, or MLS PIN MLS: October 31, 2018 to February 26, 2025;
(e) Homes in Alabama, Georgia, Indiana, Maine, Michigan, Minnesota, New Jersey, Pennsylvania, Tennessee, Vermont, Wisconsin, and Wyoming, but not on the Moehrl MLSs, the Burnett MLSs, or PIN MLS: October 31, 2017 to February 26, 2025;
(f) For all other homes: October 31, 2019 to February 26, 2025
Note that the end of the settlement period is based on the notice date, which varies settlement by settlement. As of today, the longest settlement class periods run through February 26, 2025.
Note that 97% of the several hundred MLSs nationwide are NAR-affiliated and thus subject to all of the mandatory NAR MLS rules challenged in this litigation, and that even for the few non-NAR MLSs it was was common among these MLSs to adopt restraints that were identical or similar to those imposed by NAR.
Also note that 91% of all homes sold in the US are listed on an MLS.
