UEBT and the California Attorney General alleged Sutter Health violated California antitrust and unfair competition laws by including contract provisions with major health insurers that restricted price competition among Sutter and other Northern California hospitals/providers, overcharging self-funded payors for hospital services and ancillary products.
Self-funded payors that were (1) California citizens or arms of California, and (2) compensated Sutter Health for general acute care or ancillary products. California citizenship includes entities organized under California law, or headquartered/principally based in California as of the April 7, 2014 filing date.
