Several 2007 class actions accused US Foodservice (USF) of racketeering, breach of contract, and price-fixing; the cases were consolidated in the District of Connecticut in 2008. Class certification was appealed to the Second Circuit and then the U.S. Supreme Court, and was upheld.

Any company or individual in the United States that purchased products from US Foods under a cost-plus arrangement during the class period, where US Foods used a value-added service provider (VASP) to calculate cost.
